Terms of Service

These terms govern your use of the LuxLeads AI platform. By signing up or using any part of the service, you agree to these terms. Please read them carefully.
1. The service
LuxLeads AI ("we", "us", "LuxLeads AI") provides an AI-powered lead capture chatbot platform that integrates with Facebook Messenger, Instagram Direct, WhatsApp, and website chat widgets ("the Service").
The Service is intended for businesses and sole traders ("you", "the Client"). It is not intended for personal or consumer use.
2. Account and access
You must provide accurate information when setting up your account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
You must be authorised to connect any Facebook Page or Instagram account you link to the Service. By connecting a page, you confirm you have the necessary admin rights.
We reserve the right to suspend or terminate accounts that violate these terms, misuse the platform, or engage in activity that breaches Meta's Platform Policies.
3. Subscription and payment
LuxLeads AI is offered on a monthly subscription basis at £297/month (or as otherwise stated at the point of purchase). Pricing is exclusive of VAT where applicable.
Subscriptions are billed monthly in advance. Your subscription renews automatically each month unless cancelled before the next renewal date.
Payments are processed securely by Stripe. We do not store your payment card details. Failed payments may result in suspension of your account.
All fees are non-refundable except where required by law or at our sole discretion.
4. Cancellation
You may cancel your subscription at any time by contacting us at [email protected] or through your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date.
We may cancel or suspend the Service with 30 days' written notice. In the event of termination by us without cause, we will refund any prepaid fees for unused periods.
5. Use of the service
You agree not to:
- — Use the Service to send spam, unsolicited messages, or misleading communications
- — Send marketing messages without a valid lawful basis or without giving recipients a clear way to opt out
- — Attempt to reverse-engineer, copy, or resell any part of the platform without written consent
- — Use the Service for any unlawful purpose or in violation of Meta's Platform Policies
- — Misrepresent your business, products, or services through the chatbot
- — Interfere with the security or integrity of the platform or its infrastructure
We reserve the right to remove or modify any content or configuration that we determine violates these terms or applicable law.
6. Facebook and Instagram integration
The Service connects to Meta's platforms via the Meta API. Your use of the Facebook and Instagram integration is subject to Meta's Terms of Service and Platform Policies in addition to these terms.
We are not affiliated with Meta Platforms, Inc. Any changes Meta makes to its API, policies, or platform may affect the Service. We will make reasonable efforts to adapt to such changes but cannot guarantee uninterrupted availability of Meta-dependent features.
You are solely responsible for ensuring your use of the chatbot complies with Meta's messaging policies, including obtaining any necessary consent from end-users.
7. Data and privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these terms.
You remain the data controller for any personal data collected from your customers through the chatbot. We act as a data processor on your behalf. You are responsible for having a lawful basis to process that data and for informing your customers appropriately.
On cancellation or account termination, we will retain data for up to 90 days then delete it, unless you request earlier deletion.
If we process personal data on your behalf, our Data Processing Addendum applies unless we agree a separate written data processing agreement with you.
8. AI, professional advice, and human review
LuxLeads AI uses automated systems to generate replies, classify enquiries, and route leads. AI responses may be incomplete or inaccurate. You are responsible for reviewing and supervising how the chatbot represents your business.
The Service does not provide medical, legal, financial, emergency, or other regulated professional advice. You must not rely on the Service as a substitute for qualified professional judgment, and you must ensure urgent or sensitive enquiries are handled by an appropriate person.
9. B2B outreach and marketing compliance
If you use LuxLeads AI for outbound outreach, you are responsible for ensuring your campaigns comply with UK GDPR, PECR, anti-spam rules, and any equivalent laws that apply to your recipients.
You must not hide your identity, must honour unsubscribe or stop requests, and must keep an appropriate suppression list. We may suspend outreach features if we believe they are being used unlawfully or abusively.
10. Intellectual property
All software, AI models, templates, and platform components remain the intellectual property of LuxLeads AI. These terms do not grant you any ownership rights.
You retain ownership of your business data, customer conversations, and lead information collected through your account. By using the Service, you grant us a limited licence to process this data solely for the purpose of providing the Service.
11. Limitation of liability
To the fullest extent permitted by law, LuxLeads AI shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of or inability to use the Service.
Our total liability to you for any claim arising under these terms shall not exceed the fees paid by you in the three months preceding the claim.
We do not warrant that the Service will be uninterrupted, error-free, or that AI responses will always be accurate. You are responsible for reviewing and managing the chatbot's responses to your customers.
12. Changes to these terms
We may update these terms from time to time. We will notify you by email or via the platform at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
